Last session, the South Dakota Legislature passed and Governor Dennis Daugaard (R) signed into law House Bill 1190. HB 1190 created a Gold Card concealed pistol permit, as well as upgraded South Dakota’s existing Enhanced permit. Since the permits were created or upgraded in 2016, permit holders were waiting for proper ATF approval to see if the new and upgraded permits would meet the minimum ATF requirements for a NICS background check exemption when purchasing a firearm. Today, with the distribution of an open letter, the ATF has informed South Dakota Federal Firearms Licensees that the Gold Card permit holders and the upgraded Enhanced permit holders who were issued their permits on or after January 1, 2017 are eligible for NICS background check exemption when purchasing a firearm.
