Last weekend, New Mexico Governor Susana Martinez (R) signed into law House Bill 336. Sponsored by state Representative Nate Gentry and state Senator Daniel Ivey-Soto, HB 336 brings New Mexico into compliance with the federal NICS Improvement Amendments Act of 2007 (NIAA). This legislation ensures that records of individuals prohibited by federal law - specifically, those who are adjudicated mentally defective or committed to a mental institution - are included in the NICS system. To date, 38 states have passed measures similar to HB 336.
In addition to bringing New Mexico into compliance with NIAA, HB 336 provides an open channel for restoration of an individual’s right to possess a firearm through the court system once a disqualifying condition has been removed. The measure creates no new categories of prohibited persons and does not expand records check requirements to private firearms sales.
