An important “emergency powers” protection bill that would ensure your right to self-defense is not infringed on by the government during a declared state of emergency will be considered by the state Legislature tomorrow.
In its amended form, Legislative Bill 390, introduced by state Senator Mark Christensen (44), would strike the word “firearms” from the list of items the Governor may suspend during a declared state of emergency. While the amended language does not go as far as the original legislation, it still protects Second Amendment rights by ensuring that the Governor does not have the power to prohibit or restrict the otherwise lawful possession, use, carrying, transfer, transportation, storage or display of a firearm.
LB 390 would protect citizens in Nebraska from a violation of their constitutional rights reminiscent of what occurred in New Orleans after Hurricane Katrina, where law-abiding citizens were stripped of their lawfully owned firearms by overzealous government officials, leaving them defenseless and unable to protect their families and property.
