The operative clause of the Second Amendment — The right of the people to keep and bear Arms shall not be infringed — was nearly erased from the Constitution in 1939 by a muddled and confusing Supreme Court opinion in United States v. Miller. But, apparently embarrassed by seven decades without a coherent explanation of the right celebrated during the Framing era as "the true palladium of liberty," the court rediscovered the Second Amendment.
