Fairfax, VA—City Attorney Dennis Herrera's statement today that he will seek appeal of the trial court ruling is a blatant attempt to suppress the fact that San Francisco is guilty of violating the civil rights of its law-abiding residents. Mr. Herrera advances no legal arguments other than his personal "disagreement" with the court's thoughtful and well-reasoned legal opinion. California's preemption law is clear and unambiguous and was used previously to strike down a similar measure passed by the Board of Supervisors. Only the means of enactment were changed here and that is not enough to amend how the law is to be read.
