On August 3rd, the Center for Biological Diversity (CBD and several other groups filed a petition with the US Environmental Protection Agency (EPA) to ban lead in ammunition and fishing tackle under the Toxic Substances Control Act (TSCA). TSCA addesses the production, importation, use and disposal of specific chemicals and/or chemical mixtures.
CBD recently launched a campaign to ban the use of lead in ammunition, nationwide. It has been in the forefront of efforts to ban hunters' use of lead ammunition in California and Arizona.
Below is NRA's letter to the EPA Administrator detailing why the EPA does not have the authority under TSCA to regulate ammunition and, consequently, cannot accept CBD's petition.
EPA is required to respond to the petition within 90 days.
